Understanding why bail may be denied in a criminal case
Bail is set according to a local bail schedule or by a judge. Bail may be denied for a number of reasons including the nature of the crime or if the defendant is a flight risk. While most criminal cases are eligible for bail, it is not a guarantee. A special bond hearing may be held in a particular case because of the egregious circumstances surrounding the crime or because the defendant has exhibited a high likelihood to become a fugitive. Representatives from the prosecution and the defense may present arguments for their respective sides and the judge must then decide whether to allow or deny bail.
