The Daily Bail Report – DUI, High BAC, Bail and Failing to Appear

DUI-BACToday we posted bail for a 28 year old girl for her 3rd dui with a BAC of .30. (Legal limit in CA is 08) out of North Justice Center in Fullerton. The judge only required a $10,000 bond for which she failed to appear on us. After a week or so of looking for her she came to her senses and contacted our office to turn herself in. We suggested she turn herself in at the court in order to avoid sitting in jail for too long. This morning we met her at the court and the judge was not happy that she had a 3rd dui, she blew a .30 and she has had a few failures to appear so he remanded her and set a $20,000 bail on her. The family is now faced with a difficult decision of getting her out of jail and getting her the help she needs or leaving her in jail to learn a lesson for a little while. This is usually the biggest decision for a family to make when considering bail. In our opinion if she is ready to get the help she needs then they should post bail. If she is just going to resort to the same lifestyle and not really learn her lesson then they should think twice about posting a bond.

It’s one thing to have a case and face charges but its another to thing to fail to appear on a case. It usually upsets the judge to a point where they will put the person in custody and make them think about it for a little while. Sometimes the judge will bring the person back in later the same day or give them a couple days in jail before they bring them back to the court. We wish her the best and hope that the judge sees that maybe she was just too scared to show up and face the consequences and won’t hold it against her.
