Over the course of my 22 years in the bail bond industry I have probably done 25 1275 hearings and 1 or 2 nebia hearing in Federal Court. Each and every case has been different but we have always won them because we usually prepare really well. About 2 months ago we had a client that wanted to have a 1275 at the last minute (the next day). Usually we prepare for the hearing a week ahead of time and make sure that the Defense Attorney and DA have a copy of the 1275 we are presenting. But in this case they wanted it last minute and said they would supply us with all the necessary paperwork in court that morning. Indeed they brought everything they needed and everything we required to win the 1275. This was one of the more lengthy hearing I have ever done. It started at 9am and ended at 3pm. Multiple people including myself had to testify to explain to the judge where the money was coming from. After roughly 6 hours of testimony, discussion, lunch break and more testimony the judge approved the lifting of the 1275 hold.
Today I had a case where I was totally prepared and had prepared the client for their 1275 hearing over the last few days and when we went into court the Defense Attorney was able to talk to the DA in the hallway and agree to lift the hold. We were well prepared to testify but the attorney worked her magic and got the DA to agree to lift it. Nobody had to testify and the hold was lifted.
Not all 1275 bail hearings are the same. Most have their own circumstances and issues but either way we always win.
A 1275 Hearing is when the DA and the Judge want to know where the client got the money to pay the bail bond company. They want to make sure that the money used to pay the Bondsman was not from the defendant and not from anyone that might have had something to do with the alleged crime. For instance, on drug sales cases the DA wants to make sure that the money used to pay the bail bond company was not from the person accused of the selling the drugs.
