The Bail Bondsman's Role....

The process involves a contractual undertaking guaranteed by a Licensed Bail Bondsman and the individual posting bail. A Bail Bondsman guarantees to the court that a defendant will appear in court each and every time he or she is required to and that if the defendant does not make their appearance that the Bondsman will pay the court the full amount of the bond. At this point the client is still liable to the Bondsman to pay the full amount of the bond if the defendant did not show up for court.

In California there are three filed rates that a Bail Bondsman can charge. (8%, 10% and 15%) 8% bonds come with different conditions that the defendant must meet and they are only offered by a few Surety Companies. 10% is the standard for California. 15% is for "High Risk" bonds. Meaning a Bail Bondsman can charge 15% if he or she has determined that the client is a high risk. If a Bail Bondsman is charging less than 8% they are in direct violation of California law.

The Defendants Role....

After an arrest the defendant will be given a court appearance date. The defendant must make all of their court dates to satisfy the requirements of the court and of the Bondsman. If the defendant does not appear in court a warrant will be issued by the court and the bondsman will then begin the investigations process. Defendants are responsible to the Court, the Cosigner, the Bondsman, and the Surety Company.

Cosigners Role….

A cosigner is a person that guarantees to the Bondsman that the defendant will appear in court each and every time he is required to appear. If the defendant does not appear in court the cosigner is then responsible to pay the bondsman the full amount of the bail. Collateral is not always required from a cosigner. There are many varying factors that determine if collateral is necessary. Please call for more information.
