Penal Code 594
If a person is arrested for violating penal code 594, the person is arrested for vandalism. In some cases, vandalism is a misdemeanor while in others it is a felony offense. The assumptive bail amount for vandalism is $5,000 in all counties across the state of California.
If a defendant is offered the opportunity to get out of jail on bail, many defendants choose to pay the bail in exchange for their freedom while they await trial. In order to pay bail, the defendant will have to supply the court with the full amount of the bail. If the defendant has been arrested for vandalism in conjunction with another violation, such as resisting arrest, then the assumptive bail amounts for each of these offenses will be added together to create the full bail amount that the defendant has to pay.
Many defendants use a bail bonding agency to help pay the bail amount. A bail bonding agency will provide the full amount of funds needed in order to pay bail. In exchange for these funds, the defendant will pay the bail bonding agency a fee that is usually equal to ten percent of the total cost of the bail. So, for example, if the defendant has a bail amount of $5,000, the bail bonding agency will supply the courts with a bail bond in the amount of $5,000 and the defendant will supply the bail bonding agency with a non-refundable payment of $500 in exchange for its services.
The defendant then agrees to fulfill the legal obligation to the court, which includes attending all trials. If the defendant fails to fulfill the full legal obligation, then the bail bonding agency will go after the defendant to rearrest him. Sometimes, the agency will use a bounty hunter in order to track the defendant down.
Also, if a defendant fails to fulfill the legal obligation to the courts, the defendant may forfeit his possession of some collateral that he may have put up to the bail bonding agency in exchange for service. However, if the defendant does fulfill the legal obligation, then the bail bonding agency will receive a refund of the bail amount, regardless of whether the defendant was guilty or innocent of the vandalism charges.
