Penal Code 529

When a person is arrested for violating penal code 529, the person has been arrested for false impersonation of another. This crime can be either a misdemeanor or a felony and carries an assumptive bail of $15,000. For example, if a person is approached by a police officer and asked for identification, the person would be violating penal code 529 if he hands over another person’s identification card.

When a person is arrested for such a violation, the person may be eligible for release from jail on bail. Depending on the circumstances, some officers will elect to let a person go from jail on his or her own recognizance for this particular violation as well. However, if bail is the only way to get out of jail while awaiting trial, the defendant may wish to contact a bail bonding agency.

A bail bonding agency is available to help a defendant pay the full amount of bail that is required in order to get out of jail. The agency will generally charge the defendant about ten percent of the total bail amount in exchange for its services. When the bail bonding agency pays the bail bond to the court, the defendant is released into the custody of the agency. The agency is then responsible for ensuring that the defendant fulfills his or her legal obligation to the court.

In the event that the defendant fails to appear for a court date, the bail bonding agency will track the defendant down to rearrest him or her and take her before the court. The defendant may also forfeit his or her right to collateral that he or she may have put up in exchange for the services of the bail bonding agency.

If the defendant fulfills the full legal obligation to the court, then the bail bonding agency will receive a refund of the bail amount, regardless of whether the defendant was guilty or innocent.
