Penal Code 487
When a person is arrested for violating penal code 487, the person is arrested for grand theft. Grand theft is a felony offense that carries an assumptive bail amount of either $20,000 or the amount of the theft – whichever is greater. There are also a variety of subcategories to penal code 487. For example, penal code 487F is petty theft of a dog, which carries a bail of $5,000.
Similarly, if a person is arrested for penal code 488, the person is arrested for petty theft, which is a misdemeanor that carries a bail of $5,000. Penal code 490.5 is petty theft of merchandise or library materials, which carries a bail of $5,000.
When a person is arrested for any of these penal code violations, some officers will allow the person to leave jail on his or her own recognizance. However, the defendant may also have to stay in jail until he or she can pay bail. In order to pay bail, the person may wish to speak with a bail bonding agency about its services.
A bail bonding agency is an organization that is in place to provide the defendant with the full amount of money necessary to make bail. When the bail bonding agency works with a a defendant, the defendant will need to pay the agency a fee that is generally about ten percent of the total amount of the bail. This fee, however, varies based on each bail bonding agency.
The bail bonding agency will also likely wish to have some collateral, such as cash, real estate or stocks, to hold onto. In the event that the defendant fulfills the full legal obligation to the courts, the bail bonding agency will release this collateral back to the defendant. However, if the defendant fails to fulfill a legal obligation, then the defendant will probably forfeit his or her rights to the collateral. As such, it is always in the defendant’s best interested to fulfill any and all legal obligations to the courts.
When the defendant fulfills the legal obligation, the courts will release the bail bond back to the bail bonding agency, which is, in essence, a refund. However, if the defendant fails to fulfill the obligation, then the bail bonding agency may exercise its right to track down the defendant through the use of a bounty hunter. The bounty hunter may rearrest the defendant and return him or her to court.
