California Bail Information and Charges

Vehicle Code 40508b

When a person violates Vehicle Code 40508b, the person is guilty of failing to pay a fine as promised after a violation. The bail for this offense is roughly the same as a fine and should not exceed $250. The base fine begins at $35. There is a $40 fee for state services, a $28 fee for county services (which may change depending on the county, and a $20 court fee in addition to the base bail amount.

When it comes to Vehicle Code violations, it is common for there to be “additional penalties” associated with the fine that the defendant has to pay. These penalties are generally between $18 and $23. The cost of these penalties is broken down as follows: there is a $10 state penalty required by Penal Code section 1464, there is a court facilities construction penalty of between $0 and $5, which is required by Government Code section 70372(a) and modified by Government Code section 70375(b), there is a DNA Identification Fund penalty of $1 that is required by Government Code section 76104.6; and a $7 county penalty required by Government Code section 76000(e)). These penalties are levied upon every $10, or a fraction thereof of every fine, penalty, or forfeiture that the courts collect for criminal offenses.

In most cases, defendants will pay this amount out of pocket or by using a credit card. However, bail bonding agencies may also be available to provide defendants with financial assistance when paying these fines. Contact a bail bonding agency to find out whether or not they have payment plans that will help you pay these fines if you require additional assistance.
