Vehicle Code 40508a
When a person fails to appear in court to stand trial for a Vehicle Code violation, they are violating Vehicle Code 40508(a). This violation carries a bail amount or fine of up to $250, though it is usually about $134, depending on county court fees. In addition to paying the fine for failure to appear, the defendant will also have to pay the fine(s) associated with the original violation. If the defendant was originally jailed for the offense, then the defendant may be jailed again for failure to appear after being released from jail on bond the first time.
Not all vehicle code violations are associated with jail time. But in the event that the defendant is jailed pending his or her trial, chances are good that the defendant may be denied bail because the defendant failed to show up in court the first time. However, depending on the unique circumstances of the case, the defendant may be released on bail.
If the defendant is given the option to be released from jail on bail, then the defendant has the option of using the services of a bail bonding agency to provide the funds for that bail. A bail bonding agency will provide the full amount of bail for the defendant in exchange for a down payment. The down payment is usually a percentage of the total amount of the bail, which is usually set at a rate of ten percent.
In the event that the defendant skips court again, then the bail bonding agency will not receive a refund of the bail amount, unless the agency can track the defendant down and deliver him to jail, in some cases. However, if the defendant shows up to court, then the bail bonding agency will get a refund of the down payment. The defendant will not receive a refund of the down payment.
The best way to avoid fines and the unnecessary loss of money is to show up to court and fulfill all legal obligations.
