California Bail Information and Charges

Penal Code 288

When a person is arrested for penal code 288, the person has committed lewd or lascivious acts with a child. Such acts are considered felonies. There are a variety of variations and subcategories under this heading, which include the following:

Penal Code 288 – Child molesting, lewd or lascivious acts involving children.

Penal Code 288(a) – child molesting of a child under the age of 14. The bail for this felony offense is $5,000.

Penal Code 288(b) - child molesting with force.

Penal Code 288(c) – child molesting a child aged 14-15 years old by an adult that is 10 years older. The bail for this felony offense is $30,000.

Penal Code 288 a – oral copulation.

Penal Code 288.5 – continuous sexual abuse of a child.

Penal Code 289 – rape with a foreign object. This felony offense has a bail rate of $5,920.

Penal Code 289(j) – penetration of genital or anal openings by a foreign object of a child under the age of 14.

If a person is given the opportunity by the courts to get out of jail on bail for any of these offenses, the defendant may appeal to a bail bonding agency for assistance in paying bail. The bail bonding agency will front the full amount of the bail in the form of a bond to the court. The agency will receive a refund of this money when the defendant fulfills his or her full legal obligation to the courts.

The bail bonding agency may hire a bounty hunter to track down a defendant if the defendant fails to appear in court. The bail bonding agency may also collect on collateral payments that the defendant may have made available to the bail bonding agency as payment if he or she fails to show up in court.

Otherwise, as long as the defendant fulfills his or her legal obligation, the defendant will only have to pay the bail bonding agency a down payment for its services. This down payment is usually about ten percent of the total amount of the bail.
