California Bail Information and Charges

Penal Code 246.3

When a person is arrested for penal code 246.3, the person has been arrested for shooting a firearm in a grossly negligent manner that could result in injury or death. This is a felony offense that comes with an assumptive bail of $25,000. The assumptive bail is the same for all counties in the state of California.

When a defendant is put in jail and given the opportunity to pay bail, the courts are basically saying that the defendant may offer a monetary assurance or promise that he or she will return to court to stand trial for the alleged offense. When the defendant returns to court, the payee of the bail will receive a refund of the bail. However, if the defendant fails to return to court, then the payee will not receive a refund of the bail amount.

A popular way that many defendants pay their bails is to enlist the help of a bail bonding agency. A bail bonding agency will be available to provide defendants with the full amount of the bail that they require in order to get out of jail. IN return, the defendant will pay the agency a fee that is generally equal to about ten percent of the bail bond. This fee is usually payable by credit card, cash or personal check.

Additionally, the bail bonding agency will collect collateral that it will hold onto. If the defendant fulfills his or her legal obligation to the courts, then the bail bonding agency will release the collateral back to the defendant. However, if the defendant fails to fulfill a legal obligation, then the bail bonding agency will use the collateral as a payment for its services. The agency, after all, will not receive a refund of the bail amount.

If the defendant does not fulfill the legal obligation and fails to appear, the bail bonding agency may hire a bounty hunter to track the defendant down. The bounty hunter will rearrest the defendant and return him or her to court so that the defendant can be tried for the crime(s) that he or she is accused of committing. In such a case, the bail bonding agency may receive a refund of the bail amount.
