Penal Code 243
Penal code 243 is for battery against a person. The offense is a misdemeanor and carries an assumptive bail of $10,000. There are additional subcategories with their own bail rates as well, including the following:
Penal code 243(b) stands for battery on a peace officer, emergency medical technician or a firefighter. The assumptive bail rate is $15,000.
Penal code 243.4(a) is sexual battery or touching another person in an intimate place. The offense is either a misdemeanor or a felony and carries a bail of $25,000.
Penal code 243.5 is assault or battery on school property.
Penal code 244.5 is assault with a stun gun or taser, which is a felony offense with a bail rate of $50,000.
When a person is arrested and put in jail for violating any of these penal codes, the person may be given the opportunity to get out of jail on bail. If the defendant is able to get out of jail on bail, he or she may consult with a bail bonding company, which will provide the money to help fund the bail bond. In exchange for the funding, the defendant will pay a fee to the bail bonding company that is equal to about ten percent of the total amount of the bail.
When a defendant fulfills his or her legal obligation, the bail bond will be refunded to the bail bonding agency. However, if the defendant fails to fulfill a legal obligation to the court, the bail bonding agency will not receive a refund. The agency may then collect on collateral that the defendant had been required to place with the agency for such a circumstance. The agency may also enlist a bounty hunter to track down the defendant and return him or her to court.
If the defendant had put up collateral with the bail bonding agency and fails to fulfill a legal obligation, then the defendant will lose that collateral. Often, the collateral that a defendant uses may include an automobile, stocks, cash or real estate. As such, it is always in the defendant’s best interest to return to court in order to stand trial for the offense that he or she has been accused of committing. |
