California Bail Information and Charges

Vehicle Code 23152a

When a person is arrested for violating Vehicle Code 23152, the person has been arrested for driving under the influence of alcohol or drugs. The bail for such a violation is about $1,500. There are different subsets of codes under the blanket code of 23152. Each subset is created based on a different type of drug or alcohol as well as the resulting injuries that may have been caused by the offense.

When a person violates vehicle code 23152(a), the person is arrested for driving under the influence (DUI) of alcohol or drugs. When a person is arrested for violated Vehicle Code 23152(b), the person is arrested for driving under the influence (DUI) of drugs or alcohol with a blood alcohol level over .08%, which is the legal limit in California.

In addition to being arrested for these Vehicle Code violations, a person may also be arrested for a related offense if they cause injury or death of another person on the road, including their own passenger. If a person violates Vehicle Code 23153(a), the person has committed a felony offense by driving drunk and causing death or injury. If the person is arrested for violating vehicle code 23153(b), the person is arrested for driving drunk with a blood alcohol level greater than .08%, which is also a felony. The bail for these offenses is about $1,500 and may include additional fees or bail amounts as well, depending on the particular arrest.

When a person is arrested and granted the opportunity to make bail, then the person can pay the bail amount and be released from jail while he or she awaits trial. However, the defendant must fulfill all duties to the court, including appearing at all trials or responding to all phone calls that were scheduled with a probation officer.

If the defendant wishes to, he or she can enlist the help of a bail bonding agency in order to make bail. The bail bonding agency will pay the full amount of the bail bond for the defendant in exchange for a down payment. The down payment is usually about ten percent of the amount of the bail. If a bail is set at $1,500, then the defendant would have to pay $150 to the bail bonding agency in such a scenario.

The bail bond down payment is not refundable to the defendant, even if the defendant is found to be innocent of the charges. However, the bail bonding agency that provided the money to the defendant can get a full refund of the bail bond amount if the defendant fulfills his or her duty to the court.
The defendant is responsible for paying the bail bonding agency a non-refundable down payment that is usually equal to about ten percent of the total cost of the bail. In the event that the defendant is found to be innocent of the charges, the defendant will not receive a refund of the bail amount.
