California Bail Information and Charges

Penal Code 12025

When someone is arrested for violating penal code 12025, they are arrested for carrying a concealed weapon. The violation is considered to be a misdemeanor and has a $5,000 assumptive bail bond. The assumptive bail bond for each county is the same for the same offense.

For some serious offenses, the defendant is not allowed to leave jail on bail, especially if the defendant is considered to be a violent criminal, as might be the case with an arrest that is associated with a concealed weapon. In such a case, a judge might be called in to determine whether or not to allow bail for the defendant.

When a defendant is given the option to get out of jail on bail, the defendant may require financial help in order to pay the bond. A popular way of getting that financial help is to consult with a bail bonding agency. A bail bonding agency will provide the defendant with the bail amount that will allow the defendant to get out of jail.

In order to use the services of a bail bonding agency, a defendant will need to provide the agency with a down payment for the bail bond. Most bail bondsmen charge ten percent of the total cost of the bail for the down payment. As long as the defendant goes to court and fulfills all of his legal obligations, the bonding agency will not charge the defendant any additional money. However, if the defendant fails to go to court on his or her day of trial, then the bonding agency will charge the defendant extra fines.

Often, a defendant will pay the down payment with credit or by putting up collateral for the cost of the down payment in addition to assurance that the defendant will go to court. If the defendant fails to go to court, then the bail bonding agency may collect that collateral as payment.

Also, a bail bonding agency is authorized to use bounty hunters and law enforcement to track down a defendant that fails to attend a court date. The U.S. is the only country that still allows private bounty hunting for defendants that fail to go to court.
