California Bail Information and Charges

Penal Code 12020

If a person is arrested for violating penal code 12020, the person has been arrested for the manufacturer, importation, sale, or possession of a disguised firearm or deadly weapon. This is a felony offense that has a bail set at $10,000. The type of offense and the assumptive bail amount will be the same for every county in the state of California.

When a bail option is offered to a defendant, the courts are saying that they will let the defendant go free until his or her trial dates are finished. In exchange for that freedom and as a surety that the defendant will fulfill a legal obligation to the court, the courts impose a bail, which is the amount of money that the defendant must put up in order to get out of jail. Once the defendant fulfills the legal obligation, this amount of money is refundable. However, if the defendant fails to fulfill the obligation, the amount is turned over to the courts.

Many defendants choose to use the services of a bail bondsman when they make bail. The bail bondsman will provide the funds for the full amount of the bail in exchange for a down payment from the defendant. The down payment is a non-refundable fee that is usually equal to about ten percent of the total cost of the bail. For example, if a person has a $10,000 bail, then the bail bonding company will provide the court with a bond in the amount of $10,000 and the defendant will provide the bail bonding company with a down payment of $1,000.

The bail bonding company will then help to make sure that the defendant fulfills the legal obligation to the court. In the event that the defendant flees before a trial, the agency will hire a bounty hunter or other legal official to track down the defendant and rearrest him or her. The defendant will then have to pay fines and may lose assets that it had given the bail bonding company as sureties.
